Please review the retainer agreement below. By agreeing to the terms and completing your payment, you will retain our legal services.
THIS AGREEMENT is made between Law Offices of Albert Goodwin, PLLC, referred to in this agreement as “attorney” and "we" and the client, referred to in this agreement as “you” in order to set out the terms and conditions under which attorney will represent client.
Attorney agrees to represent Client in connection with the investigation and defense of allegations of welfare fraud. This representation includes consultation and advice regarding the welfare fraud investigation, communication with prosecutors and investigating agencies, review and analysis of evidence and discovery materials, negotiation with the District Attorney's Office, representation at all necessary court appearances through disposition, preparation of legal motions and documents as necessary, and legal counsel regarding potential plea agreements or trial preparation.
a. Initial Retainer: Client agrees to pay an initial retainer fee of six thousand dollars ($6,000), which is due upon execution of this Agreement.
b. Court Appearance Fee: In the event that court appearances become necessary, Client agrees to pay a fee of five hundred dollars ($500) per court appearance. This fee becomes due when the court appearance is scheduled and is payable within one (1) week of the date the appearance is scheduled, regardless of the date of the court appearance itself.
Costs and expenses beyond the fees above are not foreseeable. However, if there are any costs and expenses, client shall be responsible for all costs and expenses incurred in connection with this matter, including but not limited to court filing fees, service of process fees, expert witness fees, investigation costs, transcript costs, and travel expenses.
Client agrees to provide complete and truthful information to Attorney, promptly respond to Attorney's requests for information and documentation, appear at all scheduled court appearances and meetings, promptly notify Attorney of any changes in contact information, and pay all fees and costs as set forth in this Agreement.
In the unlikely event of a disagreement, both parties agree to submit to arbitration by the New York State Court System Attorney-Client Fee Dispute Resolution Program.
Client acknowledges that Attorney has made no promises or guarantees regarding the outcome of this matter. Any expressions about possible outcomes are based on Attorney's professional judgment and should not be construed as guarantees.
Attorney will keep Client reasonably informed about the status of the matter and will promptly respond to Client's reasonable inquiries. Client consents to communication via telephone, mail, and email at the contact information provided.
This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations, agreements, and understandings regarding this matter. Any modifications must be in writing and signed by both parties.
This Agreement shall be governed by the laws of the State of New York.
